Marketplace Agreement

This Marketplace Agreement ("Marketplace Terms") supplements the Terms of Service and governs buying, selling, licensing, offering, reselling, drops, print orders, brand product sales, commissions, and related commerce on All the Rage.
1. Roles
- Sellers include creators (Visionaries), collectors reselling owned pieces, print shops in our network, and brands selling through sponsor storefronts.
- Buyers include collectors and other users purchasing goods, licenses, or services.
- All the Rage provides the marketplace platform and payment facilitation. Unless we explicitly identify ourselves as the seller, we are not a party to your transaction.
2. Listings
Sellers must:
- Accurately describe items (title, medium, dimensions, condition, edition, year, flaws, AI generation if applicable)
- Set truthful shipping terms and fulfillment timelines
- Honor the price and terms at time of purchase (subject to legitimate error correction before a binding sale)
- Comply with laws governing their goods (including export restrictions, cultural property laws, and fashion labeling)
- Not list prohibited items (see Section 10)
Sellers may offer items as fixed price, auction, drop (limited edition), offer/trade, license, print, made-to-order, or rent/buy (film/video) as supported by the Service.
3. Platform fees
All the Rage charges platform fees on qualifying transactions. Fees are deducted from seller proceeds unless otherwise disclosed at checkout.

Creator Pro lowers the take-rate to 3% on marketplace sales, drops, offers, licenses, ownership transfers, and challenge prizes. Other flows keep their standard rate. The rate shown at the time of the transaction controls.
Payment processing fees (e.g., Stripe ~2.9% + $0.30) are separate and may be borne by buyer, seller, or split as disclosed at checkout.
4. Payments and escrow
- Card and supported payment methods are processed by Stripe (and Connect for seller payouts).
- For physical goods, buyer funds may be held in escrow until the buyer confirms delivery or a dispute is resolved.
- Sellers must complete Stripe Connect onboarding to receive payouts.
- We may place payout holds on accounts with elevated dispute rates, policy violations, or fraud risk.
You authorize us to charge your payment method for purchases, pledges, licenses, tips, and applicable fees you initiate.
5. Shipping and delivery
- Sellers are responsible for packing and shipping physical items per the tier selected (parcel, freight, white-glove, local pickup, or quote-on-request).
- Quote-on-request tiers: seller arranges carrier quote after receiving buyer address; buyer pays quoted shipping before shipment.
- Buyers must provide accurate delivery addresses.
- Risk of loss passes per the shipping terms disclosed at checkout (typically upon confirmed delivery to buyer for escrow release).

6. Auctions and live bidding
- Auctions are binding when you win and payment succeeds, subject to our deadbeat-winner policy (seller may re-offer to next bidder after grace period if winner fails to pay).
- Minimum bid increments, anti-snipe extensions, and timers are enforced by the platform.
- Live bidding during streams follows the same settlement rules when a lot closes.
7. Offers and trades
- Cash offers and trade offers may be sent to the current owner of a piece (not necessarily the original creator).
- Accepting an offer triggers ownership transfer and applicable fees as implemented by the platform.
- Trades involving physical goods may open fulfillment orders for both parties.
8. Resale and royalties
When a piece carries a certificate or royalty configuration:
- Original artist royalties on resale are enforced only for sales completed on All the Rage as disclosed at listing.
- Resellers must have lawful right to sell the physical item or digital entitlement they transfer.
- Platform fees apply to resale transactions separately from artist royalties.
9. Licenses (music, film, etc.)
- Sellers offering licenses must specify tier (personal, commercial, exclusive, etc.) and scope.
- Purchasers receive rights only as stated in the license terms shown at purchase.
- Exclusive licenses may deactivate further sales of that tier as implemented.
- Deliverables (masters, stems, project files) are released through gated delivery after payment.
10. Prohibited items and transactions
Sellers may not list or transact:
- Stolen, counterfeit, or illegally obtained goods
- Items violating export/sanctions laws
- Weapons, drugs, unlicensed pharmaceuticals, or other illegal products
- CSAM or exploitative content
- Items infringing third-party IP (unauthorized prints, bootlegs, etc.)
- Securities, investment contracts, or lottery tickets (unless legally authorized)
- Services that violate our Community Guidelines
11. Taxes
Sellers are responsible for determining, collecting, and remitting applicable sales tax, VAT, GST, income tax, and other taxes. We may provide tools or collect tax where we are legally required to do so as a marketplace facilitator in certain jurisdictions.

12. Cancellations and seller obligations
- Sellers must not cancel completed sales except as permitted by law or mutual agreement with buyer.
- Failure to ship, materially misdescribed goods, or chargeback fraud may result in account suspension, payout holds, and liability for buyer refunds.
13. Brand storefronts and product orders
Brands may list products for sale on-platform or link to external stores. On-platform sales follow these Marketplace Terms. Click tracking on external links does not constitute our endorsement of external merchants.
14. Disputes between users
First, try to resolve directly via messages. If unresolved:
- Open a dispute through order tools within the timeframe stated in Buyer Protection policy
- We may review evidence (tracking, photos, messages) and release, refund, or split escrow at our reasonable discretion
- We are not obligated to mediate every dispute but may do so to protect marketplace integrity
